Trinh Nguyen is qualified to practice law in both Australia and Vietnam. She is one of a few Vietnamese nationals who have gained admission to practise in both common law and civil law jurisdiction. She holds a Master of Laws (advanced) in Commercial Laws from Queensland University (Australia).

Trinh’s experience is honed by working at International firms such as Freehills, Phillip Fox (in Vietnam) and HopGood Ganim (in Australia) and Vietnamese leading law firms over the past fourteen years where she as has been exposed to a myriad of issues that may arise in the corporate life of a company when it does business in Vietnam.

Additionally, Trinh’s diverse background as a journalist/columnist on investment issues for one of the most popular newspaper in Vietnam prior to her legal practice enables her to provide the clients with a more comprehensive view and unique perspective in advising on the intricacy of doing business in Vietnam.

Her current practice areas focus on construction/infrastructure projects and real estate where she represents large international and national developers, construction companies, engineering consulting companies in both front end and back end of construction laws. Trinh has worked on prestigious projects including Saigon M&C Tower, one of the highest building in town, Vietcombank Tower and a series of buildings owned by Saigon Commercial Bank located in various provinces across the country. Ms Trinh has advised major players in the construction industry in Vietnam such as Arup Ove & Partners, one of the biggest engineering firm in the world, China State Engineering and Construction, Ong & Ong Architect, Duffill Watt, Indochine Engineering, whose names are associated with many large projects across the country.

Besides, Ms Trinh also provides corporate and contractual advisory and assists foreign clients in electing a suitable business structure/vehicles for their business. Ms Trinh’s advice is sought by large international corporations which require legal strategic advice for their long term projects and business plans within Vietnam or with Vietnam. To name a few, her corporate clients include V-ship, a shipping company with 850 offices over the world, Slumberger, Nelson Bowers, a renowned US millionaire in his plan to expand business in Vietnam, Pentago International Ltd, My Securities Overseas, a subsidiary of CIG group, a top ten investment Bank in Russia in its acquisition of equity in Vietnam, Vietnam USA Association Groups and Australian Vietnamese International school system in its business investment plan; Thanh Nien Newspaper in its plan for development of new headquarter, Century 21 joint stock company, a corporation in which Tuoi Tre Newspaper holds major shares in its negation with Lehman Brothers.

Prior to this current position, Trinh was a partner at one of the largest local firm overseeing significant corporate and contractual negotiation on behalf of the firm. Trinh is the immediate past member of the Steering Committee of International Lawyers Group, HCMC chapter. Trinh served as Board Member, Head of Communication and PR sub-committee of Pacific International Arbitration Centre, where she is appointed as an arbitrator for the term of 2008-2011.

Experience

Trinh Nguyen’s notable transactions include:

- Consulted large Vietnamese corporations in their transactions with multi-national companies on contractual issues, construction bidding nominee arrangement or vice versa;

- Current practice areas focusing on construction/infrastructure projects and real estate whereby I represent large international and national developers, construction companies, engineering consulting companies in both, the front end and back end of construction laws;

- Worked in conjunction with Herbert Smith Freehills to provide consultation to Petro Vietnam on an off take agreement with one of the largest and most modern partially foreign owned refinery in Vietnam;

- Advised a large player in Petrochemical industry in restructuring its business model and provide contractual advisory;

- Experience in construction/infrastructure projects includes work done on the Saigon M&C Tower project, the second tallest building in Ho Chi Minh City, project worth US$700 million the Vietcombank Tower project, several buildings owned by Saigon Commercial Bank located in various provinces across Vietnam; master-planning and constructing multiple complex buildings in a prime location in Ho Chi Minh City, assisting a reputed developer in one of the largest development projects in Vietnam;

- Advised major players in construction industry in Vietnam such as: Arup Ove & Partners; China State Engineering and Construction, Ong & Ong Architect; Duffill Watt, CPG International;

- Provided corporate and contractual and good governance advice and assisted foreign clients in electing suitable business structures/vehicles for their business building legal strategy for clients’ long term business plans within Vietnam or with Vietnam;

- Prior experience in this respect includes work done for V-ship, a shipping company with 850 offices across the continents; Schlumberger; Pentago International Ltd; My Securities Overseas, a subsidiary of CIG group which is a top ten investment Bank in Russia in its acquisition of equity in Vietnam; Vietnam USA Association Group; Australian Vietnamese International school system in its business investment plan; Thanh Nien Newspaper in its plan for development of new headquarter; Century 21 joint stock company in its real estate development plan and cooperation discussions with (the then) Lehman Brothers; Speedmark and Princetonhall, the largest logistics companies with numerous offices in the world in a transaction acquiring the equity in a logistics company in Vietnam; Getz Bros in a transaction to acquire a large chain of Medicare stores national wide;

- Acted as counsel in the arbitration proceedings with respect to disputes arisen from complex commercial transaction valued at multi-million dollars; in particular, defending a complicated commercial and contractual claim by one of the largest cosmetic company in the world;

- Acted as counsel for one of the largest joint-venture petroleum company in Vietnam in an international arbitration arising from non-performance of the contract and multi-million USD dollars claims for variations in a sea-based construction and successfully reached a satisfactory settlement.
