Tran Thao Uyen
Partner
Uyen obtained her LL.B at the Law University of Ho Chi Minh City in 2005 and worked at human resource and administration department of a trading company. In 2008, Uyen joined Trinh Nguyen & Partners with the view to be exposed to legal issues in the legal areas the firm is specialized in.
Uyên joined Trinh Nguyen & Partners from 4/ 2008 to present. Prior to that, Uyên worked for a company specialized in transport and moving as a human resource. At this company, Uyên is in charge of labor related issues, legal issues in daily business activities of such enterprise. Uyên was voted by BOD as excellent employee of the year for the company.
Graduating from Ho Chi Minh City University of Law in 2005, Uyen has about 15 years of professional legal experience. In particular, Uyen has extensive experience in the field of labour and employment. Uyen handled well matters in relation to labour laws such as employment contract drafting, severance package settlement, collective agreement, strike settlement, Health and Occupancy Safety, termination labour contract.
Uyen has a lots of experience in assisting domestic and multinational companies in the matters related to corporate, foreign investment, company establishment, equity transfer, megers and acquistions, internal disputes between shareholders, commercial issues and other issues facing investors while doing business in Vietnam.
✔ Advising clients to claim their legal legitimate rights when termination the labor contract at an Internal educational organization in HCMC.
✔ Advising a foreign enterprise to avoid conflict over collective labor disputes, strikes.
✔ Advising on completing the working processes and internal regulations for a foreign company.
✔ Advising on issues related to Vietnamese labor law: terminating labor contracts, adjusting labor contracts, changing working hours for US companies in the field of oil & gas based in HCMC.
✔ Assisting advise a construction group in a complicated dispute over business cooperation contract valued at multi-million dollars;
✔ Assisting advise in the arbitration proceedings with respect to disputes arisen from complex commercial transaction valued at multi-million dollars; in particular, defending a complicated commercial and contractual claim by one of the largest cosmetic company in the world;
✔ Assisting managing partner for one of the largest joint-venture petroleum company in Vietnam in an international arbitration arising from non-performance of the contract and multi-million USD dollars claims for variations in a sea[1]based construction and successfully reached a satisfactory settlement
✔ Representing a global award winning architect group at the high court of Vietnam against one of the most powerful state-owned enterprises.
✔ Asist managing partner in representing a global award winning architect group at the high court of Vietnam against one of the most powerful state-owned enterprises.
✔ Advising on the structure of the acquisition of distribution and retail systems throughout Vietnam;
✔ Assisting in advice on transferring shares in a Vietnamese company to a multinational company in the transportation industry;
✔ Advising the Thailand oil and gas company on the conditions for pre-emptive rights to receive the equity according to the law of Vietnam;
✔ Advising on government corporate;
✔ Advising on representing in internal company disputes;
✔ Acted as counsel in matters of civil status, do not recognize parents.
Publication and researching
✔ Co-edited together with other well-known lawyers- Chapter 17 "Skills to practice law in commercial arbitration proceedings" in the Lawyer's Handbook (volume 2) – PRACTICING SKILLS IN CRIMINAL AND ADMINISTRATIVE, CIVIL PROCEDURES OF LAWYER;
✔ Assisting managing partner in drafting the lectures for the training program to improve knowledge and skills on international law and investment dispute resolution for officials of the Ministry of Justice in 2018: “Skills to participate in international investment disputes resolution by negotiation and conciliation” in order of Judicial Academy.
✔ Assisting managing partner in research, giving the opinions and reviewing the Kluwer books in the Chapter of Vietnam law, litigation issues and dispute resolution in Vietnam. Updating, reviewing to adjust relevance annually.
✔ Researching and drafting the presentations, topic as managing partner’s request.
